These terms of use govern the use of the PratiConnect platform. By creating an account or using our services, you accept these terms in their entirety. If you do not agree with these terms, please do not use our platform.
Acceptance of Terms
Clicking the "I accept" button or using the Services constitutes full and unreserved acceptance of these Terms of Use. These Terms may be modified at any time; continued use after modifications constitutes acceptance of the new terms.
Account Creation
Eligibility
To create an account, you must be at least 18 years old and be a healthcare or wellness professional (regulated or non-regulated). You must be legally capable of entering into a contract.
Registration
You agree to provide accurate, complete, and up-to-date information during registration. Any false declaration may result in the suspension or deletion of your account.
Account Security
You are solely responsible for maintaining the confidentiality of your credentials. You must immediately inform us of any unauthorized use of your account. Two-factor authentication is strongly recommended.
User Responsibilities
As a user, you commit to:
- Using the Platform in accordance with applicable laws and professional ethics rules
- Ensuring patient consent before recording their health data
- Securing your own workstation and access to the Platform
- Not sharing your credentials with third parties
- Keeping your professional information up to date
Prohibited Activities
The following activities are strictly prohibited:
- Using the Platform for illegal purposes
- Attempting to access other users' data
- Bypassing the Platform's security measures
- Using the Platform to distribute malicious content
- Mass harvesting data without authorization
- Impersonating another person or entity
- Reselling or redistributing access to the Platform
- Using the Platform contrary to its intended purpose
Intellectual Property
Platform Property
The Platform, including its source code, design, graphics, and features, is the exclusive property of PratiConnect. Any reproduction, modification, or exploitation without authorization is prohibited.
User Content
You remain the owner of the data and content you create on the Platform. By using the Platform, you grant us a limited license to store, process, and display your content in the context of the Services.
License of Use
We grant you a non-exclusive, non-transferable, revocable license to use the Platform for your professional activity, for the duration of your subscription.
Data and Privacy
The collection and processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use.
Health Data
As a health professional, you are jointly responsible for the processing of your patients' health data:
- You must obtain explicit patient consent before entering their data
- You commit to using patient data only in the context of care
- You must comply with the regulations applicable to your profession
Service Availability
We strive to ensure continuous availability of the Platform but do not guarantee uninterrupted access. Maintenance or technical failures may cause temporary interruptions. We commit to informing users of planned maintenance.
Liability
Limitation of Liability
Our liability is strictly limited to direct, proven damages. We are not liable for loss of data, loss of profits, or any other indirect damage.
Disclaimer
The Platform is a technical management tool. We do not assume any responsibility for medical or therapeutic decisions made by practitioners. Each professional remains solely responsible for their clinical practice.
Indemnification
You agree to indemnify and hold harmless PratiConnect against any claim, demand, or damage arising from your use of the Platform or your breach of these Terms.
Termination
By the User
You can terminate your account at any time from your account settings. Data deletion is carried out in accordance with our Privacy Policy.
By PratiConnect
We reserve the right to suspend or terminate your account in case of breach of these Terms, particularly in case of illegal activity or use contrary to the Platform's purpose.
Effects of Termination
Upon termination, you retain access to your data for 30 days for export. After this period, your data is permanently deleted, subject to legal retention obligations.
Modifications
We reserve the right to modify these Terms of Use at any time. Modifications will be communicated by email or notification on the Platform. Continued use after the modifications come into effect constitutes acceptance.
Applicable Law
These Terms of Use are governed by French law. In case of dispute, the French version of these terms will prevail over any translation.
Dispute Resolution
In case of dispute, you agree to first contact our customer service to seek an amicable solution. In the absence of a resolution within 30 days, the dispute may be brought before the competent courts of Paris.
Severability
If any provision of these Terms of Use is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
